Terms of Service

1. Acceptance of Terms

By accessing or using Probefish ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Probefish is an LLM prompt and endpoint testing platform that allows you to create test suites, validate LLM outputs, and integrate testing into your development workflow.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities under your account

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Transmit malicious code or interfere with the Service
  • Attempt to gain unauthorized access to any systems
  • Use the Service to generate harmful, illegal, or abusive content
  • Resell or redistribute the Service without authorization

5. API Keys and Third-Party Services

You are responsible for your own API keys for LLM providers (OpenAI, Anthropic, Google, etc.). You must:

  • Comply with each provider's terms of service
  • Ensure your API usage stays within your plan limits
  • Keep your API keys secure and confidential

We are not responsible for any charges incurred from your use of third-party LLM providers.

6. Subscription and Payment

Paid subscriptions are billed in advance on a monthly or annual basis. Subscription fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days notice.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Probefish and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of your test cases, prompts, and data. By using the Service, you grant us a limited license to process this data solely to provide the Service to you.

8. Software License

Probefish software is licensed under the Elastic License 2.0 (ELv2). See our License page for full terms. Key limitations include:

  • You may not provide the Software as a hosted service to third parties
  • You may not circumvent license key functionality

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROBEFISH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless Probefish and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the Service will cease immediately.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page. Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Probefish operates, without regard to conflict of law principles.
